Tim Cumper Defies Creative Commons License and Cease & Desist Warnings

  

Tim Cumper sent an email message addressed to Noemi today and was CC’d to Jepoy and Reyna Elena. This email proves that Tim Cumper was lying (again) on his mass Facebook message to Jepoy’s friends and family. He claimed,

“…I cannot communicate directly with Jepoy – for he has blocked me from the sites and groups that he has been organising – my right to reply has been robbed.

If Jepoy is close to you – please urge him to desist and remove all propaganda – for his own benefit – for very soon there will come a knock at the door.“

If his message was true, then the succeeding messages you are about to read will not be possible at all. He knows our email address so his messages on Facebook can be considered stalking and threatening (emphasis on the bold text)

Now let’s check out the email exchanges between Jepoy and Tim Cumper.

Here you can see that Tim Cumper has again accused Noemi Dado of creating the Facebook page. To dispel anymore lies that Tim Cumper has been spreading about not being able to communicate with these people, Jepoy replied. He clarified the claim of Tim Cumper that Jepoy stole and cloned his blogs. He’s been spreading these lies on Twitter and Facebook’s NetworkedBlogs App.

I did not copy or clone your site… it was directly saved from Google’s cache so no alterations or modifications were made, you can see that the links are all intact. I simply copied your contents from Google’s cache, well… that makes Google a thief too? You are a funny old man.

Now let me point to you, you’ve altered the Filipina Images’ logo without any permission… you stole our picture and edited it without permission… you copied my blog contents without attribution… NOW THAT’S STEALING!

Jepoy’s email response clearly indicates that Tim Cumper completely forgot about the Creative Commons licensed he placed on his blogs. His license states that,

Jepoy refused to remove Tim Cumper’s blog archive from Google on TCW as these articles were published under that specific license, plus the fact that his site continues to display the license

You have no right to demand that… you removed your content while the license was still in place, in fact, the license is still there until now, so no, you cannot demand to remove it just like that. It has been cached on Google’s servers so technically, your deleted contents are all under creative commons and are all archived on Google.

You can revoke the license, only on contents published from now on. Learn to understand licenses before you place them on your blogs mmmkayy?

Here is another proof that Tim Cumper’s published work is not deleted, just hidden from public eyes. Why? Possibly that he don’t want others to read them since the TCW was established to create awareness on his cyber stalking and cyber bullying activities.

Who says that the content is deleted? Not me – it’s in draft mode right now OK.
That is my intellectual property and I am revoking any authority you may think you have.
The material is not deleted at all.
It is under review – OK.

I have every right to demand that you desist from distributing my intellectual property – after I have expressly required you to do so.

Tim Cumper forgot that his articles have already been published and the Creative Commons license applies to all published articles. Google and the Wayback Machine has records of them too and this website was just mirroring their contents.

Also, you can see that Tim Cumper, despite his fair Cease and Desist warning on his libelous and defamation activities, posted and edited the photo of Jepoy in way maligns his name.

The licence is intended to restrict not enable.
There are caveats – one being that permission has to be sought – further permissions – like distribution – cloning – that is not in the licence and damn well you know it.

You are directly in contravention of the licence agreement as follows.

“In addition to the right of licensors to request removal of their name from the work when used in a derivative or collective they don’t like, copyright laws in most jurisdictions around the world (with the notable exception of the US except in very limited circumstances) grant creators “moral rights” which may provide some redress if a derivative work represents a “derogatory treatment” of the licensor’s work.”

So – remove it – immediately.

Jepoy replied and said that mirroring his blog contents are under their “right to reply” since Tim Cumper has been accusing them for the past 2 years of crimes they didn’t commit. The presence of Tim Cumper’s blog archive from Google will create balance on the two sides of the story. One can read his stories and at the same time, read all entries from within the TCW website.

With this setup, a reader can create a conclusion without any bias.

Here we can see how clueless Tim Cumper is when it comes to how the internet works,

He thought the pages were “cloned” and so are his statcounter codes. What he failed to realize is that once Google archives your content, all contents will be copied too. You can also see that he’s too paranoid that he thinks we can read his forum posts because of the “cloned” pages. There are things called Google search…

He also implies that his contents will be used for criminal activities, well, he’s free to sue Google.

Jepoy – communication is the term I apply to a meaningful, honest and open two-way exchange – with a common interest being seriously discussed.

You only bothered stringing more than a few sentences together in your replies when the topic aroused you by being directly connected to what was a mere side issue – namely licences, google, caches, archives etc.
Trying to discuss anything outside that limited area was not possible because of your deliberate reticence and refusal of respect.

Hence I could not communicate with you – because your replies revealed no interest and were only useful in what they did not say.

Noemi has never replied to my emails.

Communication was being stifled, deliberately avoided.
That is the whole point of communication – which is why I apply the word – it is not simply dependent on a technical availability.

However – as any readers will see from the many screen captures of the various welcome screens employed by the campaign bloggers – my right to reply was also being inhibited by banning and blocking of my IP address from visiting or contributing to those sites.
